This new rule will apply to all city parks, Alum Rock for example has different issues than Prusch, as does Overfelt, Guadalupe, etc. Someone bit by a snake in Alum Rock will he on their own as will the child that falls off a swing at Prusch. Park maintenance staff will still be around weekdays, but there will be not one to enforce the rules that make our parks so special. Staff has been reduced at all Parks, leaving office staff to handle an unreasonable amount of problems along with their regular duties. If the Ranger Program is eliminated we can expect more thefts, more damage to are gardens and orchards, more grafiti and more conflicts. I hope this helps everyone understand what is at stake. There is some concern that the contract might include provisions that may not have been approved by the group. On June 6, there will be a further discussion of the revised contract. There were concerns that polarization and controversy follow Marni, and her view of the Green party may not conform to the 10 key values, etc. Apart from this, we need to increase our registration as a fall-out from Prop. 14. The "county polling" style election for At Large GPCA Coordinating Committee candidates ends June 30, 2011. Below are some comments for consideration before our GPSCC meeting Thursday evening June 23rd. A restructuring experiment for the CC was approved over two Plenaries. It changes the CC from 12 Regional Reps and 4 At Large CC members to 12 Regional Reps and 12 At Large seats. In the current election, there are 3 candidates for one year terms and 5 candidates for two year terms (total of 8 candidates). The idea behind the restructuring experiment (as I understand it) was to encourage new energies and individuals to take on CC responsibilities. At Large CC members are expected to be involved in County GP support. CC members, in general, are supposed to serve on CC committees and/or serve as CoCoordinators to state standing committees or be liaisons to working groups. After reading through the candidate self-descriptions about backgrounds and intentions I find myself, with two exceptions, underwhelmed... Laura Sinott, from Mendocino County seems to have strong administrative experience; Sanda Everette I know from four years on the GPUS Delegation. Sanda was a member of the GPUS Steering Committee (the national party CC parallel body) which, as near as could tell, was more dysfunctional, but also more productive, than the GPCA CC. None of the other candidates express any clear goals for their participation in the CC. None of these other candidates describe any participation on any GPCA standing committees or working groups. Joseph Feller was previously on the CC, but he fails to describe any committee work or SC/WG participation by him during that period. If the GPSCC decides that it wants to vote in this election, I recommend that we cast our four votes as follows: One Year Terms: NOC ranked 1 (no other rankings). Two Year Terms: Laura Sinott -- Rank 1; Sanda Everette -- Rank 2; and NOC -- Rank 3. BUT.... I also think we should discuss not casting any vote. At last night's CC meeting, Jim Stauffer, as an Elections Committee member, reported that quorum was one half of 32 counties reporting -- and that was before Nevada County was added to the list. Jim also reported that only 8 County GPs had reported a ballot reporter. Given that we will be using Single Transferable Vote balloting and that there are fewer candidates than seats available, it is highly likely (IMO) that all candidates will be elected if quorum is met. In addition to bringing indiciduals who probably do not understand the responsibilities they are undertaking, that election will create a bloc of three CC members from Alameda County plus an additional member from El Cerrito. Under these circumstances, it may be preferable to delay expansion of the current number of CC members and try to recruit (or hope for) better qualified candidates in a later election (which would be needed anyhow to fill vacant positions). Additionally, given the aggregious misconduct of the CC collectively in creating and approving the "Marnie contract", withholding GPSCC voting on CC elections is the only possible protest action currently available. Notwithstanding my support for Laura and Sanda to be CC members, I am inclined to propose a vote boycott. Here are some thoughts and questions I think we might consider. I don't intend this as an attack on anyone. I know that many folks have a high level of frustration, and for good reason. I would just like us to consider alternatives that may be seen as more constructive than a boycott. I apologize in advance for rambling -- I promise I won't run on like this at the meeting! If the CC expansion was intended to bring in new people and energies, it's logical that we may get candidates that haven't participated on the CC or on other state-level committees and working groups -- that's part of their newness. However, it looks like all candidates have demonstrated some level of commitment to the Green Party locally, and most of them have been around for more than 10 years. If we're not enthusiastic about these candidates, do we have anyone else to recommend? Would the people we recommend want to volunteer in that capacity? Maybe the folks we'd nominate would rather volunteer on other projects or take a break from volunteering. Do we want to leave lots of positions unfilled while we keep waiting for "ideal" candidates who won't commit to running for the offices we've selected for them, or do we want to give others -- who have said they're willing -- a chance to grow into new roles? Do folks in the GPSCC have direct negative experiences with any of the candidates that are serious enough to warrant voting against them with NOC? I would understand the logic of voting against someone who is truly incompetent at something they would need to do on the CC, or who doesn't act in accordance with Green values, but I think it's unfair to vote against NEW CC candidates because we disapprove of something the OLD CC has done. What happens if our boycott prevents quorum from being met after all? Is the CC getting enough done with the number of members it has? Is it doing the things we want it to do? What if the election of new candidates would shift the balance on the CC toward its taking more actions that we favor? Will the new candidates get discouraged if we prevent them from being elected simply because we disapprove of a vote the old CC made? Sure, it would be great if they persisted in coming back to volunteer for things because they really wanted to help, but we can't expect them to keep coming back forever if controversies they didn't create keep giving rise to actions that block their participation. How much might our boycott contribute to driving away good people? If we vote against any candidates using NOC I would prefer to see that vote be based on direct negative experiences with those individuals. If that's really true for some of them, fine. If it's not true for some of them, I would prefer to see us vote for those candidates to affirm their willingness to try to help the party and to give them the opportunity to do so. We should certainly rank the ones with the most experience and accomplishments highest. None of these candidates have done anything to offend me personally, and I have not heard that any of them are incompetent. Therefore I don't like the idea of boycotting their election. Perhaps the election will meet quorum, everyone will get elected, and a boycott will be purely a symbolic gesture. Perhaps nobody will get elected, but things will work out OK on the CC in the long run. Perhaps something else will happen... Symbolic or not, a boycott feels like a very negative gesture to me, and I'm tired of the high level of negativity. I would rather see us take positive steps to move forward. Chris Murphy: Dear Chairman Smith and Ranking Member Conyers: We write to you today to ask that you hold a hearing on HR 862, the Supreme Court Transparency and Disclosure Act. This commonsense bill would go a long way towards restoring the public's confidence in the Supreme Court after several recent questionable actions by some of its members. The Supreme Court must be a neutral arbiter that acts without bias or prejudice. We the people created our Constitution to "establish justice," and the promise that Supreme Court justices abide by the rule of law and not political influence or ideology is at the foundation of who we are as a country. This bedrock principle is important with the prospect that the Supreme Court will eventually rule on the constitutionality of legislation debated by this Congress, like the Affordable Care Act. Whatever the justices decide, the legitimacy of their decisions depend on whether the American people believe them to be impartial and above any particular political or financial interests. Yet, there have been alarming reports of justices ? most notably Justices Antonin Scalia, Clarence Thomas and Samuel Alito ? attending political events and using their position to fundraise for organizations. These activities would be prohibited if the justices were required to abide by the Judicial Conference Code of Conduct, which currently applies to all other federal judges. On these issues the code is quite clear. Canon 4C states that "a judge should not personally participate in fund-raising activities, solicit funds for any organization, or use or permit the use of the prestige of the judicial office for that purpose." Additionally, in Canon 5 the code states, "[a] judge must refrain from all political activity." While we understand that the Supreme Court is unique by its very nature, we do not believe there should be one set of guidelines for Supreme Court justices and stricter standards for all others judges. The Supreme Court possesses the incredible power to interpret or even strike down laws they deem inconsistent with the Constitution. America trusts them with this power because justices must come to each case without a personal or financial stake in the outcome. Recent revelations about Justice Thomas accepting tens of thousands of dollars' worth of gifts from individuals and organizations who often have an interest in matters before the courts calls into question the Court's impartiality. Canon 4D of the Code of Conduct incorporates regulations providing that "[a] judicial officer or employee shall not accept a gift from anyone who is seeking official action from or doing business with the court." Yet Justice Thomas received a gift valued at $15,000 from an organization that had a brief pending before his Court at the very moment they gave him the gift. Incidents such as these undermine the integrity of the entire judiciary, and they should not be allowed to continue. The Supreme Court Transparency and Disclosure Act was introduced to shine a light on these issues. First, it would apply the Judicial Conference Code of Conduct, which applies to all other federaljudges, to Supreme Court Justices. Currently, the justices only look to this standard as "guidance". Second, the bill would require Supreme Court justices to publicly disclose their reasoning behind a recusal when they withdraw from a case and when they refuse to recuse themselves after a motion is made for them to do so. Lastly, it would require the Judicial Conference to develop a process to review decisions by justices who have refused to step aside from a case. As Supreme Court Justice Louis Brandeis once said, "sunlight is said to be the best of disinfectants". It is time that we apply that same ideal to the Supreme Court.
