The anti-trust exemption, however, refers only to emergency rooms, as
far as I could tell.

Personally I'm tired of giving the cigarette companies a pass, for any
reason. Cigarettes have killed some of my friends. I voted against
indoor smoking bans in the past; no more. Etc.
