I signed it based on another e-mail I got today.  If the person generating the petition would only scan the entire Sec of State web page for the propositions vote counts they would find the report on uncounted ballots located here:

There are currently 2.3 million uncounted ballots. The percentage of no votes on Prop 37 continues to decline as more votes are counted, but not at the same rate as occurred overnight on Nov 6th-7th.  In the last 1.2 million votes counted the no votes percentage only declined by 0.3 %. This rate of decline is consistent with Prop 37 being exactly tied at 50% no to 50% yes in that batch of 1.2 million votes. I'm keeping track of the vote counts by going here: http://vote.sos.ca.gov/returns/ballot-measures/
 
There was a person interviewed on www.rt.com 's Breaking The Set yesterday who claimed that the Prop 37 vote was rigged, possibly as a conspiracy by Monsanto, though he didn't offer any evidence except for the fact that the initial no votes percentage was at odds with the opinion polls conducted just before the election.  Thanks.
