Hello, All:


       Another hearing is scheduled for next Tuesday, Nov. 27, 9 AM, 
Santa Clara County Superior Court, Dept. 9, Judge Mark Pierce, 191 North 
First Street, San Jose, CA in the case of Merritt v Mozillo, et al. 
(Case Number 1-09-CV-159993).  Countrywide (formerly led by Angelo 
Mozilo) and Bank of America asked the court to enforce two loan 
modification agreements signed by the Merritts on Feb. 24, 2009.  The 
Merritts claim that (1) the loan modifications in question are not 
valid, (2) the statue of limitations has to file such enforcement 
requests has long passed, and (3) Countrywide and Bank of America sold 
the loan to Bear Sterns and do not have standing to pursue enforcement 
of the loan.


       Your presence as an observer in the court could help ensure a 
fair hearing for David and Salma Merritt.
