Hi All,

This next court hearing will determine if Richard Winger will be fined
$250,000 for daring to challenge Top Two.  We need people to take action
this week.

My understanding is that the judge on the case is expected the make a
preliminary decision on the FRIDAY (Oct 19th) before the Monday hearing
(Oct 22nd, 9:30 am in the same place, Dept. 302, SF Superior Court, 400
McAllister St., SF  94102).

*Therefore, we need to get Letters to the Editor and phone calls out by
this FRIDAY (Oct 12th)* if we want the judge to have time to consider
them while he creates his response.

The best way for those at the court to know we are watching this case is
to call them and ask about it and / or make your opinion known about
it.  The person to call at the court is *Presiding Judge, Katherine

better legal environment for new and minor parties and independent
candidates. Winger has been publishing the monthly Ballot Access
News since 1985. His budget – $6,000 a year. Now, Richard Winger and
five other ballot activists are facing a big bill –
$243,279.50. That’s what California state court judgeCurtis E.A.
Karnow last week ordered them to pay in attorneys fees to intervenors.

     As you may know, despite seven years and hundreds of court filings,
     the Supreme Court on Monday refused to hear an appeal brought by
     Washington State's Democratic and Libertarian parties seeking to end
     the top-two primary system there. (See:

     That means that our two court cases in the Bay Area will play a
     critically important role in fighting the top-two scam.  I have two
     requests toward that effort:

     *1) Please attend this next hearing -- packing the court for this
     will again be HUGELY IMPORTANT.

     2) Can those who attended the first hearing please write a brief
     letter to the editor about what happened, and post photos from that
     morning (on social media or send to me via email and I will post)?*

     Whether you attended the first hearing or not, please consider
     sending one letter to the editor to one paper that you regularly
     read.  The attack on Richard Winger was blatant and average people
     are angered almost across the board by that.

     Additionally, most people are unaware that our ability to write-in a
     candidate's name on our ballot election day is now taken away, and
     this could be mentioned -- see:

     Letters will be important to generate media coverage  -- when news
     organizations see letters coming in they may be more likely to send
     a reporter to cover the story.

             the new hearing date for the P. 14 appeal is set for Oct. 22
             at 9:30 a.m., SF Superior Court, Room 302.

             Please mark your calendars now!  Our attendance made a huge
             difference!
